These Terms of Service, which also serve as the End User License Agreement ("EULA") for the app, form a binding agreement between you and AlphaCue Technologies ("we", "us"). You accept them by tapping "I agree" during onboarding. If you do not agree, do not use the app. We record the date and time of your acceptance and the version of these terms you accepted.
We may update these terms. Material changes are presented in the app for re-acceptance before you can continue using the service.
This service is for adults only and is rated 18+. You must be at least 18 years old to create an account or use any part of the app. You are asked for your date of birth before an account is created, and an account is never created for anyone who does not pass that check.
Misrepresenting your age is a breach of this agreement. If we learn that a user is under 18, we terminate the account immediately.
You agree not to submit, transmit, upload, or otherwise make available any content, and not to engage in any conduct, that is objectionable. Objectionable content and conduct include, without limitation:
We enforce this section without exception. Depending on severity and on the first occurrence, we may remove the content, issue a warning, suspend the account, or permanently ban the account and disable the underlying credential. Child sexual abuse material results in an immediate permanent ban, preservation of the evidence as required by 18 U.S.C. § 2258A, and a report to NCMEC.

Every moderation decision is written to an append-only audit log recording the moderator, the action, the target account, and the time.
The fastest route is the in-app Report control, available on the chat screen and on every individual message. It reaches the moderation queue directly.

Accounts are anonymous — we do not ask for your real name, phone number, or email address. You are responsible for everything done through your account. You may delete your account at any time from Settings → Delete my account; see the Data Deletion page for what is removed and what is retained.
Creating a new account to evade a suspension or ban is itself a breach of this agreement.
You keep ownership of what you send. You grant us a limited licence to transmit, store, and review your content solely to operate and moderate the service. Chats are ephemeral and are deleted from our servers once both people close the chat, or within 24 hours if only one side closes. Shared images are retained for up to 90 days for moderation purposes. Content preserved as evidence in a moderation case or under legal hold is retained for as long as the law requires.

The service is provided "as is". You are talking to strangers: we screen content and act on reports, but we cannot guarantee that another user will behave lawfully or truthfully, and we are not responsible for the conduct of any user. Never share personal, financial, or identifying information with a stranger.
To the maximum extent permitted by law, our aggregate liability arising out of or relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim, or AUD $100. Nothing in these terms excludes any right or guarantee that cannot lawfully be excluded, including under the Australian Consumer Law.
We may suspend or terminate your access at any time, with or without notice, for breach of these terms — in particular Section 3. You may stop using the service and delete your account at any time. Sections 3, 8, 10, and 12 survive termination.
These terms are governed by the laws of New South Wales, Australia, without regard to conflict of law rules. If any provision is found unenforceable, the rest remains in force. These terms, together with the Privacy Policy, are the entire agreement between you and us regarding the service.
This EULA is between you and AlphaCue Technologies only, not with Apple. Apple is not responsible for the app or its content, and has no obligation to provide maintenance or support for it. Apple is a third-party beneficiary of this EULA and may enforce it against you. In the event of any failure of the app to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); Apple has no other warranty obligation with respect to the app.
